Service Contract
THIS AGREEMENT is made between Posh Pet Services LLC (hereinafter “Posh Pet Services” or "Poshps") and (hereinafter “Owner”).
FOR AND IN CONSIDERATION of the current fees published on the Posh Pet Services website at the time this agreement is executed; acknowledged and paid by Owner and herein incorporated as part of this agreement; Posh Pet Services LLC agrees to provide loving care for the pets owned by Owner.
POLICIES:
AUTHORIZATION: Owner hereby authorizes and empowers Posh Pet Services and Pet Sitters to walk/exercise the pets in the designated locations and public areas, enter the home, feed the animals and clean up after pets. Posh Pet Services and Pet Sitter is authorized to perform care and services as outlined on this contract. Both Posh Pet Services and Owner recognize that the welfare of the animal is the highest priority.
CONTINUING OBLIGATIONS: It is understood and agreed between Owner and Posh Pet Services, that this agreement contemplates Owner will need Poshps services from time to time in the future, and is further understood and agreed that the obligations and covenants contained herein shall apply to each provision of products and/or services in the future, without the need of entering into another agreement, unless altered in writing and signed by the parties herein.
NON-SOLICITATION POLICY: Owner agrees that all services must be booked through Posh Pet Services' scheduling software, phone, text, and/or email. Certain Pet Sitters contract with Posh Pet Services. These Pet Sitters are bound by a legal contract that prohibits them from acquiring any Posh Pet Service's as their own as well as from doing any side work for Posh Pet Services Clients. Any services rendered outside of the pet care software system are considered unauthorized and will not be covered under Posh Pet Services’ liability insurance or dishonesty bond.
PAYMENT/PRICING POLICY: Owner acknowledges that payment is due immediately upon completion of a scheduled service period without further invoice or notice. Payment will be autocharged to their preferred card on file. Posh Pet Services accepts Visa, Mastercard, AMEX, Discover. If payment is not received at the time of service and is not paid in full within seven (7) days, a $25 late fee may be added to the invoice. A handling fee of $35 will be charged on all returned checks. An advance deposit may be required whenever warranted. In the event it is necessary to initiate collection proceedings on the account, Owner will be responsible for all attorney’s fees and costs of collection. The fees for services provided by Posh Pet Services are subject to change within reasonable limits, which shall be communicated to the Owner in advance. Should the Owner request, approve, or otherwise authorize additional visits or extended care beyond those specified in the original agreement or invoice, such additional services will be billed at the same rate as outlined in the invoice for the original services, unless otherwise agreed to in writing by both parties. All adjustments to service fees, including additional visits or extended care, will be documented and approved by the Owner prior to being rendered.
CREDIT CARD AUTHORIZATION POLICY: I, Owner, authorize Posh Pet Services to charge my credit card for the agreed upon pet services. My credit card will not be charged until after services are rendered. I understand that my information will be saved to my file for future transactions on my account. I may cancel this authorization at any time by contacting us. This authorization will remain in effect until cancelled.
SURCHARGE POLICY: A holiday charge of $6 will apply for each visit made on the following holidays: New Year's Eve, New Year's Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day, Christmas Eve and Christmas Day. Posh Pet Services reserves the right to charge for additional pets and add-ons while in the care of a Pet Sitter. Owner will be notified of these charges in advance via Invoice.
CANCELLATION POLICY: For Dog Walks or Pet Sits: Non-Holiday Service: 24-hour notice is required for cancellation or Owner will be charged the rate of one visit. Holiday Service: Cancellation 7-day notice is required, or the Owner will be charged for the services reserved. Early Returns: For non-holiday visits will be credited to future pet sitting visits only, no refunds will be given. No credits or refunds will be issued for early returns during holiday periods. Overnight Stay(s): A 50% non-refundable deposit is required to reserve the dates.Observed Holidays include: Easter, Memorial Day Weekend, July 4th Weekend, Labor Day Weekend, Thanksgiving, Christmas Eve & Day, Christmas Weekend, New Year’s Eve & Day, and New Year’s Weekend.
EXTRA FEES/CHARGES POLICY: Posh Pet Services reserves the right to invoice/bill at $16 per half hour or any portion thereof, for additional time spent over a 30-minute visit that is necessary for the care of the Owner's pet(s) and home. This includes service and time for the following, but is not limited to: all veterinary trips; pet illness; excessive clean-up resulting from pet incontinence; accidents or frequent vomiting; complications administering medications; obtaining pet food; medication or supplies; wait time for emergency home repair; search for pet(s) that escaped confinement or leash. Owner will be held responsible for all expenses incurred and reimburse Posh Pet Services upon return.
EMERGENCY CARE POLICY: In event of pet illness or any other medical emergency and specified vet is unavailable, pet will be taken to closest vet or Veterinary Emergency Hospital. Owner understands and agrees that attempts will be made to contact them in case of emergency and if Owner is unreachable, Pet Sitter is authorized to undertake such additional steps as may in the reasonable judgment of the Pet Sitter be necessary or appropriate for the health and welfare of the animal, including but not limited to (a) additional visits by Pet Sitter to provide care for the animal; (b) consultation with Owner’s Veterinarian listed above, or with an emergency veterinary care provider should Owner’s Veterinarian be unavailable; (c) authorizing care and treatment as recommended by Owner’s Veterinarian or an emergency veterinary care provider (excluding euthanasia) up to a maximum cost provided in your Pet Emergency and Safety Procedures form; and (d) such other steps as may in the reasonable judgment of Pet Sitter be necessary or appropriate for the health and welfare of the animal. Owner agrees to be responsible for all fees and expenses incurred for care and treatment of the animal pursuant to this paragraph, and releases and holds Pet Sitter harmless from all liabilities related to transportation, treatment and expense. Owner agrees to reimburse Pet Sitter and Posh Pet Services for any expense incurred, plus any additional fees for attending to animal’s needs or any expenses incurred for any other home/food/supplies needed. This may include blood work, x-rays, surgery, and/or other expensive procedures, but not limited to an emergency medical transport fee of $35.
Owner hereby attests to the fact that all licenses and vaccinations required by the State of Florida, and the residing County to be current according to law. Should pet sitter be bitten or otherwise exposed to any disease or ailment received from Owner's animal which has not been properly vaccinated, it will be the Owner's responsibility to pay all costs and damages incurred by the victim. Owner agrees not to hold any above party liable for competently performed treatments that do not succeed. Owner agrees to assume full responsibility for the payment for any and all veterinary services rendered. Owner also agrees to be responsible for all Special Service fees assessed by of Posh Pet Services for emergency transportation, care, and will pay such fees within 7 days.
HURRICANE/EXTREME WEATHER POLICY: In the event of an evacuation due to a hurricane or other disaster, natural or man-made, Posh Pet Services cannot take pets to their home or make Owner’s home disaster ready. Owner hereby agrees to list the people that they have designated to carry out emergency plans in their absence as part of Owner’s profile under their Emergency Contacts and Pet Emergency and Safety Procedures form. This person (people) has access to Owner’s home (keys, security codes, etc.) and is willing and able to handle the tasks necessary to safely remove any pet(s) from the home in the event of a disaster and take them to a safe location. Posh Pet Services will use discretion to implement the Owner’s plan into action and has instructed Owner that they do not advise or advocate leaving pets behind in an emergency. By executing this agreement, Owner fully acknowledges that leaving a pet behind can result in them being lost, injured, or possibly dead. In the event that no one can take the pet(s), Owner agrees to notify Posh Pet Services the safest area in the home where they can be confined to until it is safe for Posh Pet Services to travel to the home. In the event of inclement weather, natural disaster or circumstances beyond our control, e.g. acts of terrorism, etc., Posh Pet Services and Pet Sitter is entrusted to use best judgment in caring for pet(s) and home. Pet Sitter and Posh Pet Services will be held harmless for consequences related to such decisions.
KEY POLICY: In the event that Pet Sitter is required to employ a locksmith to gain entry into the Owner’s premises due to a malfunction of the lock or a failure of the Owner to leave a key, it shall be the responsibility of the Owner to reimburse for all costs incurred. The Owner expressly gives Pet Sitter the authority to employ a locksmith on Owner’s behalf in the event of the aforementioned occurrences. Owner will be responsible for all expenses incurred and reimburse Posh Pet Services upon their return. Posh Pet Services does not accept garage door openers as the only means of entry due to power outages. If Owner lives in a gated community, Owner must provide the appropriate access codes. Posh Pet Services does not hold onto keys and will not be liable for keys hidden on the premise of the Owner’s home. Posh Pet Services advises Owner to use a lockbox for key safety. In any instance where new keys are needed (ex-new home or lock change), it is owners' responsibility to provide the keys. A $20 trip fee will be invoiced if a key is not left in our care and we must make an extra trip to pick up or drop off.

TERMS & CONDITIONS:
1.) The utmost of care will be given in watching both pet(s) of the Owner and home of the Owner. However, due to the extreme unpredictability of animals, Posh Pet Services cannot accept responsibility for any mishaps of an extraordinary or unusual nature (i.e., bitings, furniture damage, accidental death, etc.) or any complications in administering medications to the animal. Nor can we be liable for injury, disappearance, death or fines of pet(s) with access to the outdoors. If Owner requests pet(s) to have outside access, Owner releases Posh Pet Services and Pet Sitters from all liability for loss, injury or death of pet(s). Owner is responsible for injury to or damage to Third Parties.
2.) If anyone else has access to Owner’s home while the pet-sitting job is being performed (ex. plumber, cleaning service, etc.), Posh Pet Services can assume no liability for any damages or losses to home of Owner or pet of Owner. Posh Pet Services and Pet Sitters are not liable and are completely indemnified for any and all liability stemming from the act(s) or failure to act of third parties, whether known or unknown, including but not limited to, friends, neighbors, relatives or other service persons, that shall enter your residence for any purpose while Posh Pet Services is caring for your pets.
3.) OWNER EXPRESSLY WAIVES AND RELINQUISHES ANY AND ALL CLAIMS AGAINST PET SITTER AND POSH PET SERVICES ARISING OUT OF OR RELATING TO THE PROVISION OF SERVICES HEREUNDER, EXCEPT THOSE ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF PET SITTER AND POSH PET SERVICES. SHOULD PET SITTER OR ANY AUTHORIZED PERSON ACCOMPANYING PET SITTER SUSTAIN ANY INJURY, DISEASE OR OTHER HARM IN THE COURSE OF PROVIDING SERVICES HEREUNDER, OWNER WILL INDEMNIFY PET SITTER AND POSH PET SERVICES AND HOLD IT HARMLESS WITH RESPECT TO ALL LOSS, EXPENSE AND DAMAGE CAUSED THEREBY, EXCEPT THOSE ARISING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT ON THE PART OF PET SITTER AND POSH PET SERVICES.
4.) In the event of a personal emergency or illness of Pet Sitter, Owner authorizes Posh Pet Services to arrange for another qualified person to fulfill responsibilities as set forth on this contract. In such case, Posh Pet Services will remain fully responsible for the proper discharge of all services under this Agreement. Every attempt will be made to notify Owner regarding such situation.
5.) Posh Pet Services reserves the right to terminate this contract at any time during a period of scheduled service if Pet Sitter determines, in his/her sole discretion, that a danger exists to the health or safety of Pet Sitter. If such concerns preclude Pet Sitter from providing further care of the pet, then Owner authorizes pet to be placed in a kennel, with all charges therefrom to be charged to Owner. Every attempt will be made to notify Owner regarding such situation.
6.) While Posh Pet Services will make reasonable efforts to complete services, in the event of inclement weather, natural disaster, national emergencies, or circumstances beyond our control (e.g. acts of terrorism, etc.,) may delay or prevent Pet Sitter's visit(s). In such a case, Owner and/or the emergency contact person will be notified so that other arrangements can be made, if necessary.
7.) Visit times are approximate and subject to change based on the needs of all pets under the Pet Sitters care. Pet Sitter is entrusted to use best judgement in caring for pet(s) and home, in the event of an emergency, inclement weather, or natural disaster, Posh Pet Services and Pet Sitters will be held harmless for consequences related to such decisions.
8.) Owner authorizes Posh Pet Services and Pet Sitters to take photos of the Owner's pet for their file and for business website or marketing collateral. All photos taken are the property of Posh Pet Services.
9.) Owner hereby attests that all licenses and vaccinations required by the State of Florida, and residing County to be current according to law and warrants that the pet(s) is in good health. In addition, owner also attests that pets are free from fleas and ticks; and if suffering from any other disease, infection and/or illness, that the pet is on proper medication and/or has been treated appropriately by a veterinarian. Owner agrees to notify Posh Pet Services of any current diseases, infections, and/or any illnesses including but not limited to fleas and ticks before a Pet Sitter comes into contact with the pet. Should Owner fail to give such notice, Posh Pet Services has the right to rescind this contract upon the immediate discovery of any such disease, infection, or ailment of the pet(s).
10.) Posh Pet Services and Pet Sitters agree to provide the services stated in this agreement in a reliable, caring and trustworthy manner. In consideration of these services, the Owner expressly waives and relinquishes any and all claims against Posh Pet Services except those arising from negligence or willful misconduct on the part of Posh Pet Services or Pet Sitters.
11.) Owner acknowledges that they have thoroughly read the terms of the Service Contract by checking the box below, he/she is providing approval for the provision of services by Pet Sitter during any service period scheduled by Owner and accepted by Pet Sitter. Upon such scheduling and acceptance, Pet Sitter/Company will be authorized to enter Owner premises and perform services without additional signed contracts or written authorization and to accept telephone reservations for future visits.
Please Note: Due to a pet’s excitement to see us, “door darting” may be attempted by a pet. We take every precaution to prevent this from occurring, but do require that all dogs and cats under our care wear an ID tag (or collar) stating their name and your phone number.
